In the paperwork, King alleges that Cher's involvement in Elijah's life is an "unwarranted intrusion" into their marital relationship and claims that her husband needs a robust, long-term treatment plan to deal with his addiction issues.

According to King's documents, Elijah is currently under long-term, involuntary institutional care at the New Hampshire State Hospital and is facing ongoing criminal and mental competency court proceedings amid his treatment. She claims that the hospital has initiated guardianship proceedings, stating that jurisdiction over Elijah's case lies in New Hampshire, not California.

In contrast, Cher's legal team argues that the court's jurisdiction should remain in California, citing that Elijah is involuntarily incarcerated in New Hampshire and has no permanent ties or home in the state. They also question whether Elijah's recent reconciliation with his estranged wife, Marieangela King, is genuine, or merely a "ruse."

King cites court documents from April 2024, in which Elijah stated that he objected to Cher's appointment as his conservator, claiming she is not entitled to priority because he was married. He also stated that Cher was "unfit to serve." Elijah's wife, Marieangela King, counters that she is entitled to be his conservator due to their marriage.

Cher's petition raises dual concerns: that Elijah suffers from some mental illness and that he lives hand-to-mouth, using trust distributions to buy drugs and put himself in danger. However, Elijah disputes these allegations, stating that he struggles with addiction but is not mentally ill. He adds that controlling quarterly trust distributions will not prevent him from engaging in self-destructive behaviors and that he can save himself from his demons without external help.

The conservatorship dispute between Cher and Marieangela King dates back to 2023, when Cher first filed a petition for conservatorship over Elijah's affairs. However, King alleges that Cher did not properly serve Elijah or herself, despite claiming they were missing. She also notes that while the conservatorship petition has been pending in California, Elijah's estranged siblings, Devon Allman and Chaz Bono, have filed to be appointed his guardians in a New Hampshire court without her knowledge.

King objects to any conservator nominated by Cher, stating that it would constitute an unwarranted intrusion into the marital relationship. She claims that Elijah already objected to his mother's prior petition in 2024 and that appointing a conservator selected by Cher would jeopardize his chances of recovery. Instead, King offers herself as a suitable conservator, stating that she is ready, willing, and able to support her husband's well-being and address outstanding financial issues.

Elijah's history of substance abuse and run-ins with the law have led his family members to express concern about his ability to manage his finances and make decisions regarding his own life. In one instance, King alleged that Elijah's brother Devon told her that the family had no interest in getting Elijah into treatment.
